01 These terms
These Terms & Conditions ("Terms") are a binding agreement between you and Zaksha ("Zaksha", "we", "us" or "our"), governing your access to and use of the Zaksha website, dashboard and filtering service (together, the "Service"). By creating an account, subscribing or using the Service, you agree to these Terms and to our Privacy Policy. If you are accepting on behalf of an organisation, you confirm you are authorised to bind that organisation.
02 The Service
Zaksha is a managed, DNS-based content-filtering service. We let you block categories of content and specific sites, and set time- and group-based schedules, across the devices you enrol — and review a record of activity from a single dashboard. Filtering is applied by directing a device's DNS resolution through Zaksha; you set up each device using the guided steps we provide for iOS, Android, macOS and Windows.
The Service is operated for you as a managed service. Dashboard statistics are computed in periodic batches (roughly every 30 minutes) and are not a live or real-time feed.
03 Best-effort filtering & bypassability
You acknowledge that DNS-based filtering is a best-effort control, not an absolute one, and that its effectiveness depends on the device and how it is managed:
- It is strongest on cooperative, managed or owned devices — for example a young child's device, or company- or school-owned devices enrolled via MDM where the configuration cannot be removed and VPN installation is restricted.
- On an adversarial or personal (BYOD) device, filtering can be bypassed: anyone able to change the device's DNS settings, install a VPN, or otherwise tunnel traffic can route around it.
- You are responsible for protecting device settings (for example with a Screen Time or device passcode and restrictions on VPN installation) where you need stronger enforcement.
The Service is not a substitute for parental, guardian or employer supervision. It is one layer of protection, and you agree not to rely on it as a guarantee that particular content will always be blocked or that a determined user cannot circumvent it.
04 Accounts & eligibility
You must provide accurate account information and keep your credentials secure; you are responsible for activity under your account. Accounts are intended to be created and operated by adults — parents and guardians, business owners or their IT staff, and school administrators. Where you enrol devices used by others (including children or employees), you confirm you have the authority and any consents required to manage those devices and to view their activity, as described in our Privacy Policy.
05 Acceptable use
You agree not to:
- Use the Service to monitor or manage devices you are not authorised to manage, or to surveil individuals unlawfully.
- Attempt to disrupt, reverse-engineer, overload, or gain unauthorised access to the Service or its infrastructure.
- Use the Service for any unlawful purpose or in violation of the rights of others.
- Resell or provide the Service to third parties except as expressly permitted in writing.
We may suspend or limit access where use threatens the security, integrity or lawful operation of the Service.
06 Plans, devices & fair use
- Home — one flat price covering a single household's devices (up to 10) on Zaksha's shared cloud, under fair use. Home is intended for personal, household use; commercial use belongs on Team.
- Team — the first 10 devices are included, with additional devices charged per device at the rates shown on the Pricing page. There is no hard device cap on Team.
- Enterprise — provided on a dedicated, isolated VPS, with scope, device count and pricing confirmed in your quote. Enterprise is for customers who need a dedicated isolated instance, longer history retention or an SLA.
Plans are differentiated by their features and intended use, not by device count alone. If your use falls outside a plan's intended scope — for example, commercial use on a Home plan, or sustained use beyond fair-use limits — we may ask you to move to the appropriate plan.
07 Billing, fees & auto-renewal
- Plans & pricing. Current pricing is shown on our Pricing page. All prices are in Indian Rupees (INR) and are exclusive of applicable taxes, which are charged in addition.
- Billing periods. Plans are offered monthly or annually. Annual plans are billed once per year and are offered at a discount to the monthly rate.
- Payment. Home plans are paid via UPI. Team and Enterprise plans are issued with GST invoicing.
- Auto-renewal. Subscriptions renew automatically at the end of each billing period at the then-current price, unless cancelled before renewal. We will give reasonable notice of any price change.
08 Cancellation & refunds
You may cancel at any time from your account or by contacting us. Cancellation stops the next renewal; your plan remains active until the end of the current paid period, after which filtering and dashboard access end. Except where required by law, fees already paid are non-refundable, and partial periods are not pro-rated. Specific refund terms, if any, are set out at the point of purchase.
09 Availability & service levels
We work to keep the Service reliable, but for Home and Team plans we do not provide an uptime guarantee or a service-level agreement. The Service is provided on an "as available" basis and may be interrupted for maintenance, updates or factors beyond our control.
Enterprise customers on a dedicated instance receive a defined service-level agreement (SLA) and dedicated support, as set out in their Enterprise agreement.
10 Disclaimers & limitation of liability
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including that filtering will be complete, error-free, or impossible to bypass. We do not warrant that the Service will block all unwanted content or that it cannot be circumvented on a device a user controls.
To the maximum extent permitted by law, Zaksha will not be liable for indirect, incidental, special or consequential losses, or for content that is reached or blocked despite the Service. Our total aggregate liability arising out of or relating to the Service is limited to the amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
11 Changes & termination
We may update these Terms or the Service from time to time. For material changes we will give reasonable notice and update the effective date; your continued use after the change takes effect means you accept the revised Terms. We may suspend or terminate access for breach of these Terms, non-payment, or to comply with law. You may stop using the Service and close your account at any time.
12 Governing law & disputes
These Terms are governed by the laws of India. Subject to any non-waivable rights you have under applicable law, the courts at Delhi will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service.
